By accessing or using the Waypoint Collective website located at waypointcollective.ca (the "Site"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the Site. These Terms apply to all visitors, users, and others who access or use the Site.

2. About Waypoint Collective

Waypoint Collective is a Canadian company that designs and delivers bespoke executive retreat experiences for senior leaders. Our programs are offered by invitation or application and are subject to separate program agreements. Nothing on this Site constitutes a binding offer or contract for participation in any program.

3. Use of the Site

You agree to use the Site only for lawful purposes and in a manner that does not infringe the rights of others. You must not:

  • Use the Site in any way that violates applicable local, national, or international laws or regulations.
  • Transmit any unsolicited or unauthorised advertising or promotional material.
  • Attempt to gain unauthorised access to any part of the Site or its related systems.
  • Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Site.
  • Use automated tools to scrape, crawl, or extract data from the Site without our prior written consent.

4. Intellectual Property

All content on this Site — including text, photography, graphics, logos, and program descriptions — is the property of Waypoint Collective or its content suppliers and is protected by Canadian and international copyright laws. You may not reproduce, distribute, modify, or create derivative works from any content on this Site without our express written permission.

5. Program Enquiries and Applications

Submitting an enquiry or expression of interest through this Site does not constitute enrolment in, or a reservation for, any Waypoint Collective program. All program participation is subject to availability, eligibility review, and execution of a separate program agreement. Waypoint Collective reserves the right to decline any enquiry at its sole discretion.

6. Disclaimer of Warranties

The Site and its content are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. Waypoint Collective does not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

7. Limitation of Liability

To the fullest extent permitted by applicable law, Waypoint Collective and its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of, or inability to use, the Site or its content. Our total liability for any claim arising from your use of the Site shall not exceed one hundred Canadian dollars (CAD $100).

The Site may contain links to third-party websites. These links are provided for your convenience only. Waypoint Collective has no control over the content of those sites and accepts no responsibility for them or for any loss or damage that may arise from your use of them.

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Ontario.
